One Person Dead in Crash with Semi Truck in Oakland

Truck13

The driver of a Toyota Camry has died after the vehicle collided with a semi-truck in Oakland. The California Highway Patrol reported the accident occurred around 3:10 p.m. According to the report, the Toyota Camry driver suffered fatal injuries. No injuries were reported for the semi-truck driver. Neither of the vehicles had any passengers, according to officials. The deceased driver was neither named nor described.

Details concerning the accident are unclear.

Wrongful death lawsuits and semi-truck accidents

The family of the victim should consider hiring a lawyer to investigate the accident. Often, when accidents occur between semi-trucks and much smaller commuter vehicles, the semi-truck driver is to blame for the accident. In these cases, the family of the victim can file a wrongful death lawsuit against the driver of the semi-truck and the company that the driver works for. Such suits are common all across the United States.

To win such a lawsuit, the family would have to allege that the semi-truck driver was negligent for the crash. Negligence is proven on a three-factor basis. You must establish that:

  • The defendant owed the plaintiff a duty of care
  • The defendant violated that duty of care
  • The plaintiff was injured as a result of that violation

In the case of car accident lawsuits, each driver owes a duty of care to other drivers to operate their vehicle in a safe manner. This is especially true for semi-truck drivers who are operating massive vehicles that can cause serious injury or death to other drivers. The role of a personal injury car accident attorney is to investigate the accident and determine whether or not the truck driver contributed negligence to the accident. If they did, then the family can sue and recover damages related to the loss of their loved one, emotional grief, and loss of financial support.

Questions a personal injury attorney will ask in a semi-truck accident

If you have lost a loved one in a car or truck accident, then you should consider hiring a personal injury attorney to investigate the claim. We will ask the defendant difficult questions. These include investigating whether or not the driver contributed negligence to the accident. If they did, then chances are good that the defendant driver and their company are liable for the death of your loved one.

We will also investigate the driver and the company they work for to determine if they have a history of causing traffic accidents, traffic violations, or other negligent conduct that could have contributed to the accident. Our role is to be your advocate through a difficult time.
