Parents File Wrongful Death Lawsuit Against Trucking Company After Daughter is Killed on Campus

The grieving family of a Cambridge cyclist who was killed in a collision with a truck last June has filed a wrongful death lawsuit against the truck driver and his employer for more than $30 million. The lawsuit, which was filed in Middlesex Superior Court, names Charles P. Blouin Inc. as the business that owned and operated the truck that struck and killed the MIT student. The 24-year-old student was fatally struck by a truck near Kendall Square last summer. The 8-page lawsuit, filed by her father, alleges that the defendant’s negligence resulted in the death of their daughter. It further alleges that the decedent suffered mortal fear of death and conscious pain and suffering as a result of the accident.

The suit is seeking $28,000 to cover hospital expenses and another $30 million for the wrongful death. The defendant company and their lawyers did not respond to a request for comment on the lawsuit.

Police have yet to release the name of the driver or the company involved in the crash. The case still remains under investigation according to the Middlesex County district attorney’s office.

An attorney representing the family said that the student’s death is an immeasurable loss for her family, the scientific community, and the world. They indicated that she was totally blameless for the accident that caused her death.

What happened? 

The victim was biking towards MIT and was struck at an intersection, according to the lawsuit. The lawsuit contends that the victim had the right of way to continue straight through the intersection when she was struck by the truck, which did not yield the right of way when making a right hand turn onto the street that the victim occupied. The victim was later transported to Massachusetts General Hospital where she died from her injuries less than an hour later.

The plaintiffs contend that the box truck that struck their daughter failed to yield the right of way. The victim was in her bike lane with a helmet on and had the right of way when the accident occurred.
